GENERAL TERMS AND CONDITIONS OF Games Apex (June 2012)

PLEASE READ THESE TERMS AND CONDITIONS BEFORE entering any service of ours prior to participating in any of our contests. By subscribing to our services or participating in any, YOU ACCEPT THESE TERMS AND CONDITIONS.

The following Terms and Conditions ("Terms" or "Terms and Conditions") apply to the products, services and competitions offered or provided through the Short Message Service ("SMS") of Games Apex (hereinafter "us" or "Supplier"), and the use of a landing page or website used by the Supplier to provide services (collectively, the "Site"). These Terms and Conditions govern the relationship between you as a user and subscriber (hereinafter "you" or "User") and the supplier, located at 53 Woodstream Blvd Unit 1, Woodbridge, ON, Canada L4L 7Y8. These Terms replace any prior agreement between you and the vendor.

1. Description of the Service Provider

The provider offers users the opportunity to subscribe to certain services and online sources ("Games Apex Services"), product offers and online material (collectively, "Services"). These services are provided to users via SMS to their wireless devices. These Terms apply to all services provided by the provider via SMS, including any new services added.

2. Subscription

Users can subscribe to online services through various landing pages managed by the vendor. Each landing page will describe the particular services the user is joining. Prices may vary depending on the wireless operator. Current prices are described in Article 6 below. By entering the PIN sent to the provided number, you acknowledge that you have subscribed.

You may cancel at any time by sending "STOP" to the assigned access code.

The supplier reserves the right to change pricing at any time by updating these Terms or notifying users via SMS. Continued use constitutes acceptance of such changes.

3. Ability to Use the Services

You must be over 18 years old to subscribe. Users under 18 must have the consent of a parent or legal guardian. You affirm that your guardian has accepted these services.

4. Availability of Services

To use the Services, you must have a mobile device and access to mobile communications. You are responsible for all related costs. The Supplier assumes no liability if information or messages are delayed, deleted, or delivered incorrectly.

THE SUPPLIER DOES NOT WARRANT THAT SERVICES OR CONTENT WILL BE UNINTERRUPTED OR ERROR-FREE. ALL SERVICES ARE PROVIDED "AS IS", "AS AVAILABLE", AND FOR PERSONAL, NON-COMMERCIAL USE.
